Terms of General Service

Parties
1.1.

In the following sections of the contract, it will be referred to as "BayPro".

Customer:
Individuals or organizations who start using and/or continue to use BayPro's services.


1.2. The Parties declare, accept, and undertake the accuracy of the information written in this contract.
 
2. Entry into Force and Duration of the Contract
2.1. The contract enters into force when the customer applies to use BayPro's services through the internet site or other methods.
2.2. The contract is valid as long as the service continues to be used.
 
3. Definitions
3.1. Server: The server managed by BayPro (workstation, computer, and all equipment that performs website presentation and email services) will be referred to as SERVER.
3.2. User: Individuals who access BayPro's servers assigned to customers or provide data flow to BayPro's servers are USERS.
3.3. Hosting: A service provided by BayPro to the Customer, consisting of renting a specified amount of space on the server for the duration specified at the end of the contract and creating email accounts through this space, hosting the website.
3.4. Misuse: All items under the heading Forbidden Activities to Be Performed.
3.5. Domain: The domain is the U.K. equivalent of "Domain Name," referring to the letters converted into domain names for Internet Protocol addresses (IP addresses) that correspond to web addresses on the Internet. For example, the letters converted into domain names for an IP address like 77.1.5.2 can be domaininiz.com.
 
4. Subject
4.1. This contract has been prepared to regulate the sales and usage conditions of the services offered by BayPro to the customer. This contract will be an addition to other contracts made with the customer. Customers who start using and/or continue to use BayPro's services are considered to have accepted the terms specified in this contract.
4.2. BayPro announces this contract primarily on the web pages located at www.baypro.com.tr. BayPro can make changes to the contract content if deemed necessary. The customer is responsible for following these changes. BayPro may amend the contract content as needed. The customer declares and undertakes that they have previously accepted these changes.
 
5. Responsibilities
5.1. BayPro undertakes to provide the specified services within the specified period as long as the terms specified in this contract are complied with.
5.2. BayPro backs up customer email, databases, web pages, and all other data. However, this does not guarantee the accuracy, freshness, or restoration of the data. Therefore, customers are responsible for their backups, and they should periodically back up their data.
5.3. BayPro provides Internet services to its customers and users, allowing for a large amount of information exchange through its system. BayPro acknowledges that the Internet has a structure that promotes free thought, is open, and eliminates boundaries. However, BayPro can apply various restrictions to ensure the continuity and security of its services. BayPro is not responsible for any damage caused by these restrictions.
5.4. The continuity and efficiency of BayPro's Internet services depend on many external factors such as third parties and institutions (U.K. Telecom, Internet Service Providers, etc.), computer hardware and software, telephone or Internet lines. Therefore, BayPro does not guarantee that its services will fully meet the customer's needs, provide error-free and uninterrupted service. BayPro is a conscientious company that makes an effort to fulfill its responsibilities. BayPro will not be held responsible for any damage that may arise due to the use of its services.
 
6. General Principles and Commitments of the Parties
6.1. The customer declares that they will act in accordance with the legal regulations while using the services provided by BayPro.
6.2. The customer is responsible for the information, data, and content they store, publish, and share on BayPro's servers.
6.3. The customer accepts not to engage in activities that may harm the server or other servers and networks connected to these servers. These activities include but are not limited to: Disrupting the security of servers and networks, preventing or prohibiting other users' access to servers and networks, and disrupting the use of services provided by BayPro to its users.
6.4. The customer cannot use the services offered by BayPro in a way that will damage the reputation of BayPro or third parties.
6.5. BayPro reserves the right to suspend or terminate the service provided to the customer if it detects that the customer violates the terms specified in this contract. In this case, BayPro will not be responsible for any data loss that may occur.
6.6. The customer cannot request compensation for damages caused by the suspension or termination of the service for the reasons specified in this contract.
6.7. The customer accepts and undertakes to pay all damages that may be incurred by BayPro due to their violation of the terms specified in this contract.
6.8. If BayPro incurs any claims or penalties due to the customer's violation of this contract, the customer is obliged to cover all these claims and penalties.
 
7. Payments and Billing
7.1. The customer must pay the fees specified for the services provided by BayPro in advance and regularly. Failure to pay the fees regularly will result in the termination of the service.
7.2. Payments can be made via the methods specified on the www.baypro.com.tr website.
7.3. If the customer does not make the payment for the service fee within the specified period, their service will be terminated automatically, and their data will be deleted.
7.4. The customer cannot request compensation for any data loss that may occur due to non-payment.
 
8. Intellectual Property Rights
8.1. The customer is responsible for all the software, scripts, databases, and content they publish on BayPro's servers.
8.2. The customer accepts that all intellectual property rights, including but not limited to copyrights, trademarks, and patent rights, related to the software, scripts, databases, and content they publish on BayPro's servers belong to them.
8.3. BayPro cannot access the customer's data on its servers without the customer's permission. BayPro cannot be held responsible for data loss due to technical problems or other problems that may occur.
8.4. BayPro may provide customer data to public institutions or law enforcement authorities upon request and in accordance with the laws in force.
 
9. Cancellation and Refund Conditions
9.1. The customer has the right to cancel the service within 7 days from the date of purchase and request a refund.
9.2. The customer cannot request a refund if the service has been used.
9.3. The customer cannot request a refund for domain registration fees.
9.4. The refund request will be evaluated within 7 days after the customer's request is received, and the customer will be notified of the result.
 
10. Termination of the Contract
10.1. BayPro may terminate this contract without notifying the customer if the customer violates any of the terms specified in this contract.
10.2. If the contract is terminated for any reason, the customer's data will be deleted, and the customer cannot request compensation for this data loss.
10.3. In case of termination of the contract for any reason, the customer is still responsible for the payment of the service fee until the termination date.
10.4. The customer cannot request a refund for the service fee in case of termination of the contract for any reason.
 
11. Confidentiality
11.1. The customer accepts that the information they share with BayPro may be used by BayPro for various purposes, including marketing and advertising.
11.2. BayPro cannot share the customer's information with third parties without the customer's permission, except for the cases specified in this contract.
 
12. Force Majeure
12.1. In case of force majeure events such as natural disasters, riots, wars, strikes, and communication problems, BayPro is not responsible for the delays and disruptions that may occur in the provision of services.
 
14. Entry into Force
13 This contract enters into force for the customer as soon as the service is started.
